1. Introduction

Welcome to Anasa Tour & Travels Co. Ltd (“We”, “Us”, “Our”). These Terms & Conditions (“Terms”) govern your use of our website, services, and travel arrangements. By making a booking with us or otherwise using our services, you agree to be bound by these Terms. If you do not agree, please do not use our services.

2. Definitions

  • Client / You / Your means the person(s) or entity making a booking through Anasa Tour & Travels.

  • Booking / Travel Arrangement means reservation of any travel service(s) including but not limited to tours, transport, accommodations, meals, guides.

  • Supplier means third-party providers such as hotels, transport companies, guides, etc.

  • Services means the travel-related services provided by us under a Booking.

3. Booking & Payment

  1. Booking process: A booking is confirmed only when we issue a written confirmation and you have paid the required deposit or full payment, as advised.

  2. Payment terms: At time of booking, you may be required to pay a deposit. The balance is due no later than a date specified in the confirmation. For some bookings, full payment in advance may be required.

  3. Method of payment: We accept payments via methods communicated at time of booking. All payments must be made in the currency stated in your invoice.

  4. Prices: Prices are quoted per person unless otherwise stated. Prices include or exclude items as specified in the tour description. We reserve the right to change prices before your booking is confirmed (e.g., due to increase in supplier costs, currency fluctuations, fuel surcharges, taxes).

4. Cancellation & Refunds

  1. By you (the Client): If you cancel your trip, you must notify us in writing. Refunds, if any, will be processed according to the cancellation policy applicable to your booking.

  2. By us (the Company): We may cancel a booking due to force majeure, insufficient participants, inability to secure supplier services, or other legitimate operational reasons. In such cases, we will offer you an alternative or full refund of amounts you have paid.

  3. Non-refundable / partial refunds: Certain portions of your booking (e.g., non-refundable tickets, certain supplier charges) may be non-refundable.

  4. Timing: Cancellation charges increase closer to the departure date. The exact schedule of cancellation charges will be provided at booking.

5. Changes to Booking

  • If you wish to amend your booking (dates, route, number of people etc.), we will try to accommodate you, subject to availability and supplier conditions, and you may be charged an amendment fee.

  • If suppliers change arrangements (e.g., accommodation, itinerary) we will inform you as soon as possible and endeavor to offer reasonable alternatives.

6. Travel Documents & Health Requirements

  • You are responsible for ensuring you have valid passports, visas, permits, vaccinations, and any other entry or health requirements for travel.

  • We are not responsible if you are denied boarding or entry because you lack required documentation or do not meet health requirements.

7. Insurance

  • We strongly recommend that you take out comprehensive travel insurance, including coverage for medical emergencies, personal injury, cancellation, loss of luggage and personal effects.

  • It is your responsibility to ensure that your insurance is valid for all countries visited and activities undertaken.

8. Liability

  1. Our liability: We act as agent for suppliers (hotels, transport, etc.). Our responsibility is limited to making arrangements as per the booking confirmation. We will not be liable for any act or omission of any supplier beyond what is recoverable from that supplier.

  2. Force majeure: We are not liable for any failure or delay arising from events beyond our reasonable control (war, terrorism, natural disasters, epidemics, strikes, acts of government, etc.).

  3. Assumption of risk: Travel involves inherent risks. By booking, you accept these risks.

  4. Maximum liability: Our total liability for loss or damage caused by our negligence is limited to a sum not exceeding the total amount paid by you for the services in question (unless otherwise provided by law).

9. Conduct & Behaviour

  • You agree to behave responsibly during your travels. We reserve the right to terminate your tour or service without refund if your conduct is dangerous, abusive or in breach of laws, or disrupts the comfort, safety, or enjoyment of others.

  • You must comply with all local laws, customs, and the instructions of our representatives.

10. Complaints

  • If you have any serious problems during your trip, you must inform our on-site representative (if applicable) or contact us as soon as possible so we can attempt to put things right.

  • After your trip, please submit any formal complaints in writing within a reasonable period (for example, within 30 days of your return).

11. Intellectual Property

  • All content on our website, brochures, promotional material is owned by us or our licensors. You may not reproduce, distribute, or use them except as necessary to use our services.

12. Privacy & Data Protection

  • We collect and process your personal information in order to provide travel services, process payments, communicate bookings, etc. We will handle your data in accordance with applicable Ugandan data protection laws.

  • We will not share your personal data with third parties except as required for the provision of your booked services, or where legally required.

13. Applicable Law & Jurisdiction

  • These Terms are governed by the laws of the Republic of Uganda.

  • Any dispute arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Uganda.

14. Changes to Terms

  • We may modify these Terms from time to time. Changes will be effective once posted on our website. By continuing to use our services or make bookings after changes are posted, you accept the modified Terms.

15. Severability

  • If any provision of these Terms is found to be invalid or unenforceable under applicable law, such provision shall be deleted or limited to the minimum extent necessary, so that the remaining provisions remain in full force and effect.
